Below is a list of all Stargate common areas. These areas are to be enjoyed by the Stargate homeowners. The association maintains these areas with the help of homeowners cleaning up after them selves.
Bylaws –
1.9 “Common Elements” shall mean and refer to that portion of the Property designated as Tracts on any recorded plat of the Property to be owned by the Association for the benefit of the Owners, including any Improvements and all easements and facilities for irrigation and drainage for the benefit of the Property and downstream users.
2.3 Owners’ Rights to Common Elements. Every Owner shall have a right and easement of enjoyment in and to the Common Elements which shall be appurtenant to and shall pass with the title to every Lot subject to the provisions of this Amended and Restated Declaration, the Articles, and Bylaws of the Association and any rules and regulations promulgated by the Association. Any Owner may delegate, in accordance with the Bylaws, his right of enjoyment to the Common Elements and facilities for the members of his family, his tenants, or occupants who reside on his Lot.
4.4 (b) Limitation of Liability of Association. Notwithstanding the duty of the Association to maintain and repair the Common Elements and other portions of the Property as authorized in the Amended and Restated Declaration, the Association shall not be liable for bodily injury, property damage, or death to any person caused by any hazardous or dangerous physical condition of the Common Elements which is not known, or would not be known in the exercise of reasonable diligence, by the Association, or the acts or omissions of any other Owner or other Persons causing such personal bodily injury, property damages or death.
